Distance Sales Contract

Buyer: the holder of the 850house Studio account through which the purchase is made, identified by the buyer's name, email and billing details entered at checkout. The buyer confirms that these details are accurate.

The subject of this contract is the sale of the product the buyer selects at checkout on https://studio.850house.co, and the parties' rights and obligations in that sale. The product is either (a) a one-off credit pack, or (b) a monthly subscription under which a set number of credits is added to the account every month.

Credits are used to send messages to the AI agent that plans, writes (HTML, CSS and JavaScript), changes and publishes the buyer's website as previews at https://sites.850house.co/<site id>/, and to generate images and brand descriptions on the service's brands page. One credit corresponds to a small amount of AI usage and credits are charged by actual usage: each message reserves 200 credits, and the unused part is returned when the turn ends. A new account receives 500 free credits once, at sign-up. Credits are personal, cannot be transferred, have no cash value and cannot be exchanged for money. One-off pack credits do not expire while the account is open; subscription credits expire as set out in section 5. Credits that expire soonest are used first: subscription credits, then free sign-up credits, then one-off pack credits, oldest first.

Larger custom builds, connecting a custom domain and hosting a site beyond the preview address are quoted and agreed separately in writing and are not covered by this contract.

Current prices (Turkish lira, VAT/KDV included):

The price that binds the parties is the total, including all taxes, shown on the checkout page at the moment of purchase. There are no delivery or other extra charges.

Payment is made by debit or credit card through our licensed payment provider (PayTR). Card details are entered on the provider's secure page and are never seen or stored by the seller. For a subscription, the buyer's card is saved by the payment provider (PayTR) and the monthly price is charged to it automatically at each renewal. Instalment options, if any, are those offered by the provider and the buyer's bank at checkout. The invoice (e-arşiv / e-fatura) for each payment is sent to the buyer's email address.

The credits are digital content; there is no physical delivery. Credits from a one-off pack are added to the buyer's account immediately after the payment is approved. Subscription credits are added when the subscription starts and again at each renewal, once that month's payment is approved. If credits do not appear within a short time after a successful payment, the buyer can contact us and we will add them or refund the payment. In any case delivery will not exceed the 30-day legal limit.

• A subscription is a contract of indefinite term. It renews automatically every month on the day of the month on which it was bought, and the monthly price is charged to the saved card. The buyer expressly approves this automatic renewal and recurring charge at checkout.
• The plan's credits are added at each renewal. Unused subscription credits carry over for one more month and then expire, so credits added at a renewal expire at the end of the following billing month.
• In line with Article 52(4) of Law No. 6502 and the Regulation on Subscription Contracts, the buyer can cancel at any time online from the account, in a way no harder than subscribing. Cancellation takes effect at the end of the current paid month: no further charges are made, and credits already added stay usable until they expire. There are no partial refunds for the current month, except under section 7.
• If the seller changes the price of a plan, it informs the buyer by email at least 30 days before the new price applies; the buyer can cancel before then.
• Upgrades take effect immediately: the new plan's credits are added and the new price applies from that date. Downgrades take effect from the next renewal. There are no annual plans.

Under article 15(1)(ğ) of the Regulation on Distance Contracts, the right of withdrawal does not apply to digital content delivered instantly in electronic form. This applies to one-off packs and to each month of a subscription once that month's credits have been delivered. Before paying, the buyer expressly approves at checkout that delivery of the credits starts immediately and that, as a result, the right of withdrawal is lost. Without this approval the purchase cannot be completed.

On top of the law, we offer the following goodwill refunds, requested by email to info@850house.co from the email address of the account:

• A one-off pack from which no credits have been used is refunded in full if the buyer asks within 14 days of purchase. Packs from which any credits have been used are not refundable.
• The first month of a new subscription is refunded in full if the buyer asks within 14 days of subscribing and none of that month's credits have been used; the subscription is then cancelled. Renewals are not refundable.
• Free sign-up or promotional credits are never refundable.
• Refunds are made to the card used for payment through the payment provider within 14 days of approval; the time it takes to appear on the card depends on the bank.
• Duplicate charges and technical billing errors are always refunded in full.

The seller will deliver the credits as described, charge only what is used for each agent turn, automatically return credits for turns that fail on its side, and stop charging a subscription once its cancellation takes effect.

The buyer will give accurate details at checkout, keep the account secure, and use the service in line with the Terms of Use. The buyer must be at least 18 years old (or have full legal capacity). If the card is used without authorisation and the bank does not pay the seller, the seller may cancel the credits delivered.

Neither party is liable for delays or failures caused by events beyond its reasonable control, such as natural disasters, war, epidemics, strikes, government actions, or widespread outages of power, internet or third-party infrastructure. If such an event prevents delivery, the buyer is informed and any amount paid for undelivered credits is refunded.

In disputes arising from this contract, the seller's electronic records, servers, databases, email records and payment provider records are binding and conclusive evidence under article 193 of the Code of Civil Procedure (HMK), without prejudice to the buyer's right to prove otherwise.

This contract is governed by Turkish law. For consumers, complaints may be brought to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or the Consumer Court (Tüketici Mahkemesi) at the buyer's or the seller's place, within the monetary limits announced each year by the Ministry of Trade. For buyers who are not consumers, the courts and enforcement offices of İstanbul have jurisdiction.

This contract is made up of these terms and the Pre-Contract Information Form. It enters into force when the buyer approves it electronically at checkout and completes the payment. For a subscription it continues until cancelled as described in section 5. A copy is sent to the buyer's email address and stored by the seller.
